Privacy Policy

This Privacy Policy describes how ICON ImagiNetwork LLC ("ICONIC," "we," "us," or "our") collects, uses, shares, and safeguards the personal information of users of the ICONIC app and related services. By using the app, you agree to this policy.

1. Scope & Introduction

ICONIC is an 18+ location-based dating service. This policy covers the PWA at theiconic.app and related features such as chat, maps, Safety Pulse, and account settings. We currently operate a Los Angeles beta. Wyoming law governs our contract with you; California privacy (including the CCPA/CPRA) and consumer-protection rules may still apply to California residents.

2. Information We Collect

A. Account and Profile Data

• Name, username, email address, password, demographic info (for example sexual orientation, gender identity, and date of birth via self-attestation), and profile photos.
• XP and gamification interactions.
• We do not require a phone number to create an account. Phone numbers we process are those you add as Safety Pulse trusted contacts.

B. Location Data

• Approximate or real-time geolocation only with your express consent (checkbox and modal) before Now Mode uses GPS.
• Hide from Now Mode disables location tracking and storage of new coordinates until you turn it off and share again.

C. User Generated Content

Photos, written bios, chat messages, and any media uploaded or sent through the app.

D. Usage Data

Device info, browser type, request logs, IP address, and activity metrics on the platform.

E. Trusted Contact Data

For safety features, we may process trusted contact phone numbers (via Twilio) or emails (via Resend) as provided by you, only in the context of a safety event.

3. How We Use Your Information

• To create and manage your account.
• To provide and improve app features (including matching, geographic discovery, and gamification).
• To enforce our Terms of Service and community standards.
• To ensure safety and monitor for abuse.
• To communicate with you (support, notices, and transactional emails/SMS).

4. Sharing & Disclosure

A. Third-Party Processors

Render (hosting/database), Mapbox/CARTO (map tiles; only data they receive is IP and the request), Twilio/Resend (messages for safety only; limited, event-based). No third-party automated moderation for UGC or media.

B. Required by Law

We may disclose information if required by applicable law, regulation, subpoena, or government request.

C. Safety and Legal Protections

We may share data to protect the rights, safety, and property of you, us, or others, including to prevent violations of our Terms.

5. Your Choices & Controls

• You may edit or delete your profile and content at any time from Settings and your card.
• You can enable Hide from Now Mode to disable location tracking and new location storage.
• Opt out of most communications, except essential transactional or legal updates.
• Account deletion and a JSON data export are available in Settings.

6. Data Security & Retention

• We use commercially reasonable safeguards to protect your data.
• Chat messages are encrypted in transit. We store them so you can read them across devices. Unsend and Vanish clear stored text. Los Angeles beta does not offer end-to-end encryption.
• Sensitive/precise location is never stored or broadcast while Hide from Now Mode is enabled.
• Data is retained as long as necessary for your use of the service and fulfilling legal obligations. Security-incident records are kept at least five years.

Data Security and Breach Notification

We implement reasonable safeguards to protect your personal information. In the event of a security breach involving your data, ICONIC will promptly notify affected individuals as required by applicable law — including Hawaii Revised Statutes §487N for Hawaii residents — and in accordance with our Data Breach Notification Policy. 7. Children's Privacy

The app is restricted to users age 18+ only. We do not knowingly collect personal information from children under 18. If we learn of underage use, we will promptly delete the account and associated data.

8. Your Rights (U.S. Residents, CCPA Compliance)

• You have a right to access, request deletion, or update your data.
• California residents may exercise additional rights per CCPA: to know, access, delete, or opt out of certain uses/disclosures. Use in-app Settings or email legal@theiconic.app.
• We do not sell your personal information.

9. Changes to This Privacy Policy

We may update this policy and will notify users via the app of material changes. Continued use after changes constitutes acceptance.
